This Clinic, presented by Professor John Lenich, is an overview and review of the Discovery Rules Subcommittee of the Committee on Practice and Procedure’s report and recommendations to the full Committee.
Both sessions will be presented in the Cornhusker Marriott’s Renaissance Room.

PROGRAM DESCRIPTION
The Discovery Rules Subcommittee of the Committee on Practice and Procedure was charged with reviewing the Nebraska Court Rules of Discovery in Civil Cases in light of the changes that have been made to the federal rules over time. The Subcommittee submitted its report and recommendations to the full Committee in December 2022.
The program will explore the substance of and reasons for the key changes the Subcommittee has proposed. Those changes include, among others, adding provisions on expert witness disclosures, claiming privileges and protections, waiving them by inadvertent production, taking depositions by videoconferencing technology, making objections with specificity, waiving untimely objections, eliminating the ability to use a subpoena duces tecum to circumvent the response times for document production requests and the notice requirements for issuance of a document subpoena, and imposing sanctions for failing to preserve electronically stored information.
The purpose of the program is not only to inform the participants of the proposed changes but also to elicit feedback on those changes.

SPEAKER INFORMATION
Professor Lenich taught Civil Procedure at the College of Law for over 35 years before he retired for the third time in 2022. He is the author of Nebraska Civil Procedure, a treatise published by Thomson Reuters. He currently serves as the Civil Reporter of the Nebraska Supreme Court Committee on Practice and Procedure and as the Chair of the Committee’s Discovery Rules Subcommittee. He also serves as a member of the LBA Board of Trustees.

All CLE clinics, including dinner, are included as part of your LBA membership.
The Lincoln Bar Association (LBA) will not be reporting your attendance to the Nebraska MCLE Commission / Nebraska Supreme Court Attorney Services Division unless you are current LBA member or pay your membership dues within fifteen (15) days after the Clinic.
